EFEKTIVITAS PERAN KEPALA DESA DALAM MENYELESAIKAN SENGKETA TANAH NON LITIGASI DI DESA KEBON MANGGU

Problems within the authority of the village government are not a few problems in
the land sector. This is because common people in village of Kebon Manggu does
not understand administrative procedures concerning land legality. Law
perspective there are two choices of ways that can be done to resolve problem there
are litigation and non-litigation. The people communities when geting problems of
land more in terest to litigation resolving then problem, namely through civil
dispute resolution courts. Although civil dispute settlement courts have advantages
including legal certainty, they also have disadvantages, or more effectiveness. The
dispute by occurs, it does not always have to be resolved through court or court
channels, because now a non-litigation dispute resolution has been born, namely
the Alternative Disput Resolution (ADR). The author uses an empirical juridical
method to answer the effectiveness of the head's role in resolving non-litigation
land disputes in village of Kebon Manggu. The results of the study show that
Community factor which lack of knowledge in how important the status of
ownership rights of the land. The factors that influence the occurrence of land
disputes in the village of Kebon Manggu are caused by the factor of inherited land
owned by the village community which is not distributed to their respective heirs,
thus triggering land disputes in the village of Kebon Manggu. And when land
dispute problems arose in the village of Kebon Manggu, the village head acted as
a facilitator who made preventive efforts by following the PTSL (Complete
Systematic Land Registration) program to prevent land disputes from occurring in
the future. Also the village head acts as a coordinator in resolving land disputes in
the community by deliberation.
