ANALISIS YURIDIS TERHADAP ANAK SEBAGAI PELAKU DALAM TINDAK PIDANA PENYALAHGUNAAN NARKOTIKA (Studi Kasus Putusan Nomor:1/Pid.Sus-Anak/2022/PN Skb)

Children are the foundation and hope of all parents. Children are the only
successors of the nation who have a big responsibility for achieving the nation's
ideals. The involvement of children in criminal acts of narcotics abuse is currently
increasingly worrying. Based on the description above, the problem that will be
studied in this research is how the justice mechanism is implemented for children
who abuse narcotics, as well as what legal considerations are carried out by the
panel of judges in criminal acts of narcotics abuse against children based on
Decision Number 1/Pid.Sus-Anak/2022 /PN Skb. The author uses a type of
normative legal research by collecting data through statutory regulations, books
and journals, and then the data obtained is analyzed using qualitative descriptive
methods. The results of this author's research show that: First, the implementation
of juvenile justice in the crime of narcotics abuse as a courier does not contain
restorative justice, which results in children being given heavy sanctions. Second,
in handing down the decision in this case the judge took into consideration both
juridical and non-judicial matters with the aim of the best interests of the child.
