Abstract

The phenomenon of slut shaming as a form of gender-based online violence is increasingly prevalent in digital spaces, yet it has not been explicitly regulated within the Indonesian legal system. This study aims to analyze the provisions of Article 5 of Law Number 12 of 2022 on Sexual Violence Crimes, particularly regarding non-physical sexual harassment, in relation to the practice of slut shaming. The research employs a normative juridical method with a descriptive- analytical specification. The approaches used include the statute approach, comparative approach, and conceptual approach. Research data are obtained from primary, secondary, and tertiary legal materials, analyzed qualitatively through legal interpretation methods. The findings indicate that Article 5 of the Sexual Violence Law can serve as a legal basis to prosecute perpetrators of slut shaming, as it prohibits non-physical sexual harassment that undermines dignity based on sexuality. However, the provision remains general and open to multiple interpretations, resulting in legal uncertainty in practice and evidentiary challenges in court. Compared to the United Kingdom and the European Union, which have progressively recognized verbal and online abuse as forms of gender- based violence, Indonesia still faces a normative gap that weakens legal protection for victims. In conclusion, slut shaming can be positioned as part of non-physical sexual harassment under Article 5 of the Sexual Violence Law, but progressive legal interpretation and more explicit regulatory reform are needed to ensure legal certainty and optimal protection for victims.
