Abstract

The absence of non-halal labels on food products circulating in Indonesia has become a critical issue in consumer protection, especially for Muslim consumers who have a fundamental right to know the halal status of products they consume. This study aims to analyze the legal framework and the application of strict product liability to business actors who fail to provide non-halal labeling, examining its alignment with the principles of legal protection and consumer justice. This research employs a normative juridical method, using statutory and conceptual approaches, with document analysis of key regulations such as Law Number 8 of 1999 on Consumer Protection, Law Number 33 of 2014 on Halal Product Assurance, and Government Regulation Number 42 of 2024. The study also incorporates findings from BPOM and BPJPH in 2024 regarding violations in non- halal product labeling. The results indicate that although the principle of strict product liability is normatively recognized in Indonesia's legal system, its implementation remains ineffective due to weak regulatory enforcement, lack of deterrent sanctions, and low legal awareness among business actors. This research concludes that regulatory strengthening, legal harmonization, and strict enforcement of the strict product liability principle are essential to ensure substantive justice for consumers and to uphold their right to accurate information and freedom of religion. The study contributes to the formulation of firmer legal policies on non-halal labeling violations and provides a foundation for future research consumer protection.
