ANALISIS YURIDIS TERHADAP KARYA MUSIK MODIFIKASI DITINJAU BERDASARKAN HAK CIPTA (STUDI KASUS: LAGU BERTEMU KEMBALI)

This research aims to analyze the legal certainty of modified works in the song Bertemu Kembali based on Article 40 paragraph (2) of Law Number 28 of 2014 concerning Copyright, which contains ambiguous meaning, as well as to examine the legal protection of moral and economic rights between the original creator and the modifier. The study takes the case of Bertemu Kembali by Melly Goeslaw, which utilizes the voice of the late Nike Ardilla through deepfake AI technology and incorporates elements from the song Duka Pasti Berlalu composed by Dadang S. Manaf. The method used is normative juridical, with statutory, conceptual, and comparative approaches. The results show that modified musical works can be protected as independent creations as long as they do not infringe upon the copyright of the original work. However, the existing legal provisions do not yet provide full legal certainty regarding the status of modified works. Therefore, more detailed regulations are needed concerning the protection of modified works and the distribution of rights between the original creator and the modifier to prevent potential legal disputes in the future.
