Abstract
This research aims to analyze the form of balance in the rights of female workers before and after the enactment of Law Number 6 of 2023 concerning Job Creation and examine the proportional and ideal form of legal protection for gender-based female workers. The problems of inequality of rights, wage discrimination, and weak protection of the biological and social needs of female workers are important backgrounds in this research. The method used is normative juridical. With a statute approach and conceptual approach. This research is based on a literature study of national laws and regulations such as the Manpower Law and the Job Creation Law, as well as international provisions such as CEDAW and ILO conventions. The analysis is conducted qualitatively on secondary data in the form of primary, secondary, and tertiary legal materials. The discussion in the research shows that although normatively the rights of women workers are still accommodated in the Job Creation Law, its implementation does not yet reflect ideal and proportional protection. Some rights such as menstrual leave, pregnancy protection, and prohibition of layoffs due to marriage are still often violated. In addition, the flexibility of work relations introduced by the Job Creation Law tends to weaken the bargaining position of women workers. In conclusion, legal protection for women workers is not yet fully proportional and equitable. Strengthening regulations and monitoring implementation are needed to ensure substantive justice and support the achievement of gender equality as targeted in the Sustainable Development Goals (SDGs).
