Abstract
The advancement of digital technology has given rise to various forms of cybercrime, one of which is revenge porn the non consensual distribution of sexual content as a form of retaliation. This crime has severe psychological and social impacts, particularly on women. Although Indonesia has regulations concerning sexual and cyber crimes, legal protection for revenge porn victims remains suboptimal, especially regarding the fulfillment of their rights to recovery and restitution. This study aims to analyze the legal protection of revenge porn victims within the Indonesian criminal law system and evaluate the realization of victims' rights through the analysis of Supreme Court Decision No. 6069 K/Pid.Sus/2023, based on Aristotle’s theory of justice. The research method used is normative legal research with statutory, conceptual, and case approaches. Data were collected through literature review of legislation, legal literature, and court decisions. The findings indicate that, normatively, revenge porn victims are entitled to protection and recovery as stipulated in Law No. 12 of 2022 on the Crime of Sexual Violence (TPKS) and Law No. 31 of 2014 on the Protection of Witnesses and Victims. However, in practice, these rights have not been fully realized. Supreme Court Decision No. 6069 K/Pid.Sus/2023 found the defendant guilty but failed to proportionally accommodate the victim’s rights, such as psychological rehabilitation and restitution. This reflects the incomplete realization of both corrective and distributive justice. The study recommends strengthening specific regulations on revenge porn and implementing responsive victim recovery procedures, including the optimization of restitution, rehabilitation, and security guarantees, to achieve comprehensive and just legal protection in the digital era.
