PERLINDUNGAN HUKUM TERHADAP PEMEGANG HAK SEWA ATAS BANGUNAN DIATAS TANAH HAK MILIK (Studi Kasus Putusan Nomor 89/Pdt.G/2016/PN.Gin)

One form of lease agreement activity is land lease. The lease agreement itself gives rise to rights, obligations and responsibilities that apply in the agreement. Where if the rights and obligations are not fulfilled either due to negligence or intent or due to an incident that occurs beyond the control of each party, it can be said to be a breach of contract, namely not fulfilling or neglecting to fulfill obligations as stipulated in the agreement made. A breach of contract in Article 1238 of the Civil Code is a condition where the debtor is declared negligent with a warrant. One form of breach of contract that occurs is a violation of the tenant's rights caused by the landowner. The purpose of this study is to evaluate the certainty and legal protection of tenants whose rights are violated by the lessor. This research is included in the specification of normative legal research with a statutory, case, and conceptual approach. The results of the study found that the results of Decision Number 89 / Pdt.G / 2016 / PN.Gin have implications for the non-fulfillment of the
tenant's rights in the event of a breach of contract carried out by the landowner, thereby creating legal uncertainty. The regulation related to renting in protecting the rights of tenants as a whole is not yet optimal because it only discusses the actions of default and preventive protection measures, this requires other legal provisions that can strengthen existing laws.
