Abstract

This research aims to review the absolute competence of the military judiciary in Indonesia regarding the adjudication of general criminal offenses committed by Indonesian Armed Forces (TNI) members. Currently, this issue leads to legal overlap concerning judicial authority between military and civilian courts, as stipulated in Article 4 paragraph (4) of TAP MPR Number VII Year 2000 concerning the Role of the Indonesian National Armed Forces and the Role of the Indonesian National Police, and Article 9 paragraph (1) of Law Number 31 Year 1997 concerning the Military Judiciary. Employing a normative juridical research
method and utilizing statutory, conceptual, historical, and comparative approaches, with a focus on the military justice systems in South Korea and Germany, this study seeks to identify and analyze legal regulations for adjudicating military members in various countries. Furthermore, this research proposes a juridical review of Indonesia's military judiciary's absolute competence for the future, connecting it with the theory of authority and the theory of legal reform. Therefore, this study is expected to serve as a recommendation for regulatory reform within Indonesia's judicial system.
