ANALISIS HAK PROPOSIONAL PEMBAGIAN ROYALTI TERHADAP PEMILIK KARYA CIPTA MUSIK BERDASARKAN PERATURAN PEMERINTAH NOMOR 56 TAHUN 2021 TENTANG PENGELOLAAN ROYALTI HAK CIPTA MUSIK/LAGU

Intellectual Property Rights constitute a form of legal protection for the products of human thought that possess economic value, including musical works. In the music industry, copyright plays a crucial role in safeguarding the moral and economic rights of creators through a royalty mechanism. Although Government Regulation No. 56 of 2021 regulates the procedures for royalty collection and distribution, its implementation still encounters various issues, particularly concerning proportional fairness, transparency, and legal certainty. This study aims to examine the legal framework governing royalty distribution and assess the effectiveness of its implementation in ensuring fair legal protection for copyright holders. Employing a normative juridical research method and a descriptive-analytical approach, this study is grounded in the theories of distributive justice and legal certainty. The findings indicate that although the National Collective Management Institution, plays a significant role in distributing royalties, the lack of clear proportionality rules and weak oversight have led to imbalances in the allocation of economic rights. Therefore, regulatory reforms and the optimization of data- based technology are essential to establish a royalty distribution system that is fair, transparent, and legally accountable.
