Abstract

This study is motivated by the prevalence of abuse cases against suspects by police officers during the investigation process, which has drawn attention due to the involvement of law enforcement institutions that should protect human rights. This phenomenon creates a moral and legal dilemma, where the police, tasked with upholding justice, become perpetrators of violations, thereby diminishing public trust in the institution. This research aims to analyze the factors contributing to the abuse of suspects and evaluate the legal protections implemented to prevent such actions. The research employs a normative juridical approach by analyzing laws and regulations, literature studies, and related case documents. Secondary data is supplemented with interviews with experts in criminal law, particularly those focusing on suspect rights protection. The findings reveal that the primary factors behind abuse include the police officers' lack of understanding of human rights, insufficient oversight, and weak enforcement of professional ethical codes. Legal protection efforts for suspects are regulated in terms of their rights during investigations, but implementation remains suboptimal. This study concludes that improving human rights training, strengthening internal oversight, and strictly enforcing laws against violators are essential to prevent similar cases in the future.
