Abstract

Songs and music are one of the most universal forms of entertainment and are favored by people around the world. One of the negative impacts of technological development is that many parties sing and even change in other words, rearrange (remix) and make a new work from different individuals. One of the popular social networking applications using remixed songs and music is the TikTok application. We need to know that in this case there is something called Derivative Copyrighted Works or in other words Derivative Works, one example is remix arrangements. Based on this description, the authors are interested in conducting research on how the legal certainty of the original creator against the derivative copyrighted works of songs and music that are rearranged remixes on the TikTok application and how the form of legal protection of derivative copyrighted works of songs and music remixes on the TikTok application. This research uses normative juridical research methods. Which is descriptive-analytical with conceptual approach and statute approach.
Based on the results of the research obtained shows Article 40 letter n “Protected creations include creations in the fields of science, art and literature, consisting of: translations, interpretations, adaptations, anthologies, databases, adaptations, arrangements, modifications and other works of transformation. In addition, the TikTok application has attempted to provide a reporting system to limit the circulation of content that violates copyright in its application. So that with the fulfillment of the obligations that have been carried out by the remix music maker who can make remix music if the work includes the public domain, gets permission, has fulfilled the obligation to pay royalties.
