Abstract

The crime of trafficking in persons or TPPO is a crime that is currently widespread, not only in Indonesia but also in the world. As a form of participation to prevent criminal acts of human trafficking, Indonesia has also ratified several international conventions related to TPPO. TPPO now comes with various modes to ensnare its victims, one of which is the mode of interning for students abroad, such as the case that is the focus of researchers, namely human trafficking using the mode of interning for UNJ students abroad. This is a warning for Indonesian law enforcement officials to be able to analyze criminal acts of human trafficking using other new modes. Internships in Indonesia do not yet have regulations that specifically regulate student internships abroad, this is a loophole that can be exploited by perpetrators to ensnare their victims. The perpetrators must fulfill the elements of TPPO in order to be accountable for their actions. Legal accountability is also important for victims. Criminal responsibility must be carried out by the perpetrator who committed the act, so that it is the obligation of law enforcement officials to be able to determine and impose sanctions on the appropriate perpetrator. In this research, the problem formulation is: first, what is the legal regulation of the criminal act of trafficking in persons using the internship mode for overseas students in the criminal law system; and second, what is the criminal liability of perpetrators of criminal acts of human trafficking using overseas student internships (case study of the UNJ overseas student internship program). This research uses normative juridical research methods which focus on the study of library materials and statutory regulations. This research method is used to answer all forms of problem formulation based on theoretical aspects of the legal system in Indonesia, and also on practical aspects where there is a need to establish a new law governing student internships abroad.
