AKIBAT HUKUM ISBAT NIKAH YANG DIAJUKAN BERDASARKAN PERKAWINAN DIBAWAH UMUR DI PENGADILAN AGAMA CIBADAK

This study examines the legal consequences of marriage legalization (isbat nikah) filed based on underage marriage at the Cibadak Religious Court. The focus of this research is to analyze the judge's consideration in granting the isbat nikah application for underage marriage and the legal implications of the decision. Related to the factors that cause underage marriage and with data obtained through a case study on the isbat nikah decision at the Cibadak Religious Court using an empirical juridical research method, namely direct interviews with the judge as a resource person and related parties, namely the informant who applied for the isbat nikah and the respondent, namely Kua where the marriage was recorded. The results of this study show that the judge's consideration in granting the isbat nikah application for underage marriage is based on various factors, including emergencies and the interests of the child as well as the factors that affect the underage marriage due to social and economic factors as well as the legal consequences of the decision include the legitimacy of the marital status and the protection of the rights of children and wives. This decision also has implications for the registration of marriage and the civil rights of couples. Thus, this study provides insight into the complexity of the legal issue of underage marriage and the role of religious courts in resolving these problems.
