BPOM has the authority to carry out supervision and inspection of drugs and food which begins with several steps and efforts such as assessment before the product is allowed to circulate including evaluation of the safety, quality benefits of drug and food products, supervision after the product is allowed to circulate, prosecution and community empowerment. According to Article 8 of the Law -Law No. 8 of 1999 concerning Consumer Protection stipulates that business actors are prohibited from trading expired goods/products to consumers. The existence of drug and food control by BPOM is important from the consumer's point of view, namely to provide health insurance, feel safe when using and consuming food products, but In fact, there are still many business actors who sell expired products. The research method that the author uses in this study is empirical legal research, namely research conducted by observation or research by going directly to the field.
