TINJAUAN YURIDIS TERHADAP PERKAWINAN YANG DI LANGSUNGKAN BERDASARKAN DUA KEPERCAYAAN YANG BERBEDA SECARA BERSAMAAN

Indonesia has a diversity of religions and beliefs, so indirectly there is potential for the practice of interfaith marriages. Law Number 16 of 2019 concerning marriage, and the SEMA decision Law Number 2 of 2023 so that the court will not grant requests for registration of marriages between different religions or marriages based on two different beliefs simultaneously. However, in some cases, couples who are getting married have different beliefs. Therefore, in this research, the formulation of the problem that will be examined is the legal certainty and consequences that apply to marriages based on two different beliefs simultaneously. This research aims to conduct a juridical review of marriages based on two different beliefs simultaneously. The research method used is normative legal research with a legislative approach to marriage which is based on two different beliefs simultaneously. In conclusion, the certainty and legal consequences of marriages based on two beliefs are simultaneously seen from the status of whether the marriage is registered or not and whether the marriage constitutes legal smuggling. This research can be a reference and material for consideration in discussing and resolving similar marriage cases in the future.
