Abstract
The criminal justice system is always developing along with the dynamics of society and the need to achieve better justice. One concept that is gaining increasing attention is "restorative justice". This concept emphasizes efforts to recover losses resulting from criminal acts by involving perpetrators, victims, and the community more actively in the justice process. In 2020, the Prosecutor's Office issued Prosecutor's Regulation number 15 of 2020 which aims to encourage the application of the concept of restorative justice in handling criminal acts. Petty theft, even though it is classified as a "minor" crime, still has a significant impact on the victim and society. Therefore, how is the concept of restorative justice applied in handling petty theft cases in the jurisdiction of Sukabumi City? The author uses normative-empirical research methods to answer the implementation of the concept of restorative justice toward perpetrators of petty theft at the Sukabumi City District Attorney's Office. The research results of the restorative justice approach, as mentioned previously, focus more on creating justice and balance for the perpetrator and victim, to achieve a more just and balanced resolution of criminal cases for the perpetrator and victim, the procedural and criminal justice process which previously focused on punishment transformed into a negotiation and mediation process. In this case, the concept of restorative justice adheres to a combined concept of due process and crime control, because this concept takes into account the principle of presumption of innocence (crime control) for the defendant and pays attention to the defendant's human rights as a human being as well as the victim's right not to be blamed in the eyes of the law, but does not forget to pay attention to efficiency in dealing with criminals. This shows that the implementation of the concept of restorative justice at the Sukabumi City District Prosecutor's Office has been carried out well and by Prosecutor's Regulation No. 15 of 2020 and Attorney General's Decree No. 227 of 2021.
