Abstract

Increasing population growth makes the economy need to be improved because with increasing population the population's need for an automatic economy will also increase, so develop your business using loan funds from banks, called credit. The bank as a creditor needs to be trusted to convince the credit given to the debtor, the debtor provides the collateral or collateral needed if he wants to borrow funds from the bank, in this case the collateral used is a certificate of land rights. After the credit agreement has been agreed upon, it is necessary to draw up a deed of granting mortgage rights (APHT) made by the Land Deed Making Officer. However, what is the legal status of certificates on land that are used as collateral with mortgage rights and the PPAT's roles & responsibilities regarding the binding of collateral with existing mortgage rights. the validity of keeping certificates of land rights by Land Deed Officials for legal relations arising from credit agreements. The method used is normative legal research. The stored land certificate is a binding collateral with a Mortgage Right. The storage of land rights certificates in the office of the Land Deed Making Officer is the will of the parties, both debtors and creditors. The authority of the Official for Making Land Deeds in keeping certificates of land rights is based on Law Number 4 of 1996 concerning Mortgage Rights.
